The SunRail website is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the SunRail website constitutes your agreement to all such terms, conditions and notices.

SunRail is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by SunRail of the site or any association with its operators.

No Unlawful or Prohibited Use

As a condition of your use of the SunRail website, you warrant to SunRail that you will not use the SunRail website for any purpose that is unlawful or prohibited by these terms, conditions and notices. You may not use the SunRail website in any manner which could damage, disable, overburden, or impair the SunRail website or interfere with any other party’s use and enjoyment of the SunRail website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the SunRail website.

Use of Communication Services

The SunRail website may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, “Communication Services”), you agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Services. By way of example and not as a limitation, you agree that when using Communication Services, you will not:

Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others. Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.

Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.

Upload files that contain viruses, corrupted files or any other similar software or programs that may damage the operation of another’s computer.

Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Services specifically allows such messages.

Conduct or forward surveys, contests, pyramid schemes or chain letters.

Download any file posted by another user of Communication Services that you know, or reasonably should know, cannot be legally distributed in such manner.

Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.

Restrict or inhibit any other user from using and enjoying the Communication Services.

Violate any code of conduct or other guidelines, which may be applicable for particular Communication Services.

Harvest or otherwise collect information about others, including e-mail addresses, without their consent.

Violate any applicable laws or regulations.

SunRail has no obligation to monitor the Communication Services. However, SunRail reserves the right to review materials posted to Communication Services and to remove any materials at its sole discretion. SunRail reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

SunRail reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, at SunRail’s sole discretion.

Always use caution when giving out any personally identifying information about yourself or your children in Communication Services. SunRail does not control or endorse the content, messages or information found in any Communication Services and, therefore, SunRail specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Services. Managers and hosts are not authorized SunRail spokespersons, and their views do not necessarily reflect those of SunRail.

Materials uploaded to Communication Services may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you download the materials.

Materials Provided to SunRail or Posted at any SunRail Website

SunRail does not claim ownership of the materials you provide to SunRail (including feedback and suggestions) or post, upload, input or submit to any SunRail website or its associated services (collectively “Submissions”). However, by posting, uploading, inputting, providing or submitting your Submissions you are granting SunRail, its affiliated companies and necessary sublicensees permission to use your Submissions in connection with the operation of their internet businesses including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submissions; and to publish your name in connection with your Submissions.

No compensation will be paid with respect to the use of your Submissions, as provided herein. SunRail is under no obligation to post or use any Submissions you may provide and may remove any Submissions at any time at SunRail’s sole discretion.

By posting, uploading, inputting, providing or submitting your Submissions you warrant and represent that you own or otherwise control all of the rights to your Submissions as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.

Termination/Access Restriction

SunRail reserves the right, in its sole discretion, to terminate your access to the SunRail website and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Florida, U.S.A. and you hereby consent to the exclusive jurisdiction and venue of courts in Leon County, Florida in all disputes arising out of or relating to the use of the SunRail website. Use of the SunRail website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment or agency relationship exists between you and SunRail as a result of this agreement or use of the SunRail website. SunRail’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of SunRail’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the SunRail website or information provided to or gathered by SunRail with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and SunRail with respect to the SunRail website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and SunRail with respect to the SunRail website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be drawn up in English.

SunCard® Terms & Conditions

Please read the Terms and Conditions carefully and keep a copy for your records.
The SunCard is SunRail’s reloadable plastic fare payment media or the “My Transit Card” on the mobile ticketing app for fare payment use at rail station fare validators, ticket vending machines and on handheld fare inspection devices. It utilizes account-based smart card technology to allow customers to load, store and use fare payment products and transfers.

In the future, SunCard may be used on the fare payment devices of participating transit partners including LYNX, Votran and other transportation partners that choose to participate in the SunCard program.

These Terms and Conditions constitute your SunCard Agreement and shall apply to all activity with respect to the use of the SunCard. The use of the SunCard for SunRail services or the services of any of the participating transit partners constitutes acceptance of the Terms and Conditions.

SunCard Purchase

Reloadable plastic SunCards may be purchased at a ticket vending machine (TVM) located at each rail station. A one-time $5.00 non-refundable cost will apply for each SunCard purchased. There is no charge for the virtual SunCard in “My Transit Account” on the app. Misuse of your SunCard may invalidate your card. SunRail reserves the right to inspect your SunCard any time for damage and abuse. It is your responsibility to maintain the SunCard in useable condition.

The SunRail system offers time-based passes, stored value and daily tickets according to adopted policy. You may load any combination of SunRail fare products into a customer account.

Pass Products

Pass products entitle passengers to unlimited usage of SunRail for the selected time period and number of zones. Pass options available are: weekly, monthly or annual. Pass products are activated upon first use and expire at the end of the pass period for consecutive calendar days.

If the rider travels outside of the zones designated in the pass, they will be responsible for valid fare for the extra zones. For a mobile pass, the rider will need to purchase a ticket that accommodates the additional zones. For a pass on a physical SunCard, the account will be charged a step-up fare to account for the extra zones. If the rider does not tap off at the destination, then they will be charged a step-up fare to account for the maximum possible trip.

Passes may be set up to automatically renew with a valid credit card on file on Rider Web. Passengers are required to pay any negative stored value balances prior to reloading passes. Pass products are available to be activated for one year from day of purchase.

Stored Value

Stored value products allow customers to place a dollar value into an account. Stored value can be used as a form of payment on the mobile app and on Rider Web. Stored value can also be used by tapping a physical SunCard at a TVU when boarding and departing the train, and upon each use the proper fare is withdrawn from the account. Stored value may be set up for automatic reloading with a valid credit card on file in the mobile app or on Rider Web. Stored value in your registered account may be accessed by any SunCard registered to that account. Stored values contained in multiple customer accounts may not be combined to pay fares.

Physical SunCard Tap at TVU

Upon presentation of a plastic reloadable SunCard at a fare validation device, the system will check for and process any time-based passes first. If a time-based pass is not present or has expired, the system will check for the minimum stored value balance associated with the SunCard or the account the SunCard is registered to. If no products or minimum stored value amount are present, the fare payment device will provide an error message and passengers will be required to add value prior to boarding the train.

If a valid pass is present on the physical SunCard, the system activates the pass or uses a previously activated, unexpired pass as fare for the ride.

When stored value is being used and the rider does not tap off at the destination they will be charged for the maximum possible trip.

One-Way & Round-Trip Tickets

All one-way and round-trip tickets are non-refundable. One-way and round-trip paper tickets purchased at TVMs are valid for travel the day of purchase only. One-way and round-trip mobile tickets are available to be activated for one year from day of purchase. Activated mobile tickets are valid for travel the same day of activation only.

Fare Payment And Card Inspection

Passengers boarding the train without valid, activated fare may be asked to exit the train at the next stop, according to fare policy regulations and SunRail’s Code of Conduct.

All passengers must have in their possession valid, activated fare prior to boarding the train. Fare is not sold onboard the train. All passengers are required to present, upon request, one of the above proof-of-payment documents to law enforcement officials or SunRail Fare Inspectors. Valid identification providing proof of eligibility for discounted fares may also be requested.

If not using the mobile app, each individual who travels on the system is required to have their own SunCard or paper ticket.

Failure to present valid proof-of-payment and/or proof of eligibility for discounted fares, upon request, is a first-degree misdemeanor and may result in a fine ranging from $50 to $1,000, arrest, and/or removal from the train (Florida Statutes 341.3025 and 812.015).

Balance Protection and Replacement

An account is automatically created when you purchase a SunCard or fare product. Although customers are not required to register accounts, registration provides additional benefits to the customer including balance protection. With balance protection, the stored value in your account will be available in the event you report your SunCard is lost, stolen or damaged and after a proper investigation is conducted. There is a non-refundable replacement card fee associated with issuance of a replacement card. If you have not registered your account, the value remaining in the account will not be available for transfer to a replacement card.

Information required to register your SunRail account and to sign up for balance protection may include: name, street address, phone number and email address to enable verification of identity. Upon activation of balance protection, you must provide SunRail with this information to validate your identity and to replace value if your card is lost, stolen, or damaged. You must inform SunRail of any changes to required information in order to maintain the privileges of balance protection. If your SunCard is lost, stolen, or damaged, you must notify SunRail immediately by visiting www.SunRail.com or by calling SunRail’s Customer Service Center at 1-855-724-5411. The TTY phone number for hearing and speech-impaired customers is 711 with the Florida Relay Service.

Once you notify SunRail that your SunCard or mobile device is lost, stolen, or damaged, your SunCard or mobile app will be disabled. You will be responsible for rides taken using your lost, stolen or damaged SunCard until you properly notify SunRail that your SunCard is lost, stolen, or damaged. You will not be responsible for unauthorized use after you properly report your card missing.

SunCard loaded with the appropriate fare product, or a valid limited use paper ticket, prior or mobile fare. to boarding the train. Passes and tickets are available at all SunRail stations, at account.sunrail.com and through the SunRail mobile application. Fare media s and are not sold onboard the train. Refunds

ALL SALES ARE FINAL. Refunds for fares purchased at a ticket vending machines are only for losses that occur due to the malfunction of a ticket vending machine, a ticket validator or the failure of a SunCard, otherwise, daily tickets are not refundable. These refunds will be in the form of an equivalent product or value loaded to a customer account. Refunds for unused stored value will be provided on customer request upon account closure. All refunds will be made to the payment method used to purchase the product. Stored value bonuses and activated passes are non-refundable.

If you have made an error and/or have purchased an incorrect fare product, prior to use, please contact SunRail’s Customer Service Center at 1-855-724-5411 for further assistance. The hours of operation of the Customer Service Center are Monday through Friday 5:30 AM-9:30 PM.

Unclaimed Property

Stored value originally purchased in a customer account is subject to Florida’s unclaimed property FL Statutes. Stored value from bonus or courtesy transactions is not considered unclaimed property.

Transaction Disputes

SunRail reserves the right to correct the balance of your SunRail account if we believe that a technical or accounting error has occurred. If you have any disputes, please contact the Customer Service Center at 1-855-724-5411. An investigation will be performed and disputes will be resolved within ten (10) business days of receipt of completed form.

Accounts On Negative List

SunCards are placed on the Negative List when customers do not comply with the Fare Policy. The Fare Policy requires that all passengers must tap on their physical SunCards prior to boarding the train and when they exit the train. Tapping on at their boarding station and tapping off at their destination station allows for their SunCard to record their fare. Cards may be placed on the Negative List due to misuse, not tapping on or tapping off or without appropriate fare or because there is a negative balance on the account. SunCards on the Negative List will receive a red X at the TVU with a message that the Fare Media is not recognized, declining the SunCard for travel.

While on the train, SunRail Fare Inspectors will validate the fare on the SunCard. If the account is on the Negative List, The Fare Inspector’s device will indicate this, and you may be asked to leave the train.

Termination of SunCard by SunRail

SunRail may terminate use of your SunCard. Upon such termination, SunRail may block use of your SunCard or request surrender of your card. Upon SunRail termination, you shall be entitled to a refund of any prepaid value remaining in your account after costs and fees have been paid under this Agreement.

Privacy Policy

Your use of the SunCard is subject to the terms of SunRail’s privacy policy found at SunRail.com. In general, SunRail may use the information it collects in connection with the SunCard program for the management and promotion of SunRail and other regional transit services and fare media. We will not sell or disclose your personal information for any purpose without your written consent, unless there is a legal requirement for such disclosure. Personal information you give to SunRail when you purchase and register your SunCard may be linked to information about the use of your card. We may use that information to implement our policies allowing for the recovery of balances on lost or stolen cards. By providing us with your e-mail address and phone number, you agree SunRail may contact you. . You may choose to not provide personal information; however, SunRail’s ability to provide enhanced customer service will be limited. No Representations as to Future Fare Structure or Fees

SunCard is a type of fare payment media and does not entitle the user to a specific fare price or fare program. SunRail reserves the right to increase fares and the cost of fare programs in accordance with applicable policies and laws. Stored cash value will be deducted at the fare, fee or rate in effect when the SunCard is presented for entry on a train, fare payment device or at a rail station.
